IV.   Minors Under the Age of 18

Our Site is not intended for anyone under the age of eighteen (18). We do not knowingly collect data relating to minors. When You register on the Site for our Services as either a Buyer or Seller, You must acknowledge that You are of legal age to make bids on Units and further agree to our Buyer and Seller Agreements.

We collect several types of information from and about Users of our Site, including the following:

• Individuals – name, date of birth, address, e-mail address, telephone number, fax number, IP address, password and photocopy of government issued photo ID with signature (“ID”);
• Businesses – company name, business address, phone number, fax number, IP address, TIN, and business license information; and
• Non-Personal Information – internet connection, equipment used to access our Site, usage details, search activity, product descriptions viewed, forms submitted, videos watched, security answers, shopping cart data, user preferences, and location data.

  We collect this information:

• Directly from You when You provide it to us; and
• Automatically as You navigate through the Site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.

Information You Provide to Us

The information that We collect on or through our Site may include:

• Information that You provide when completing forms on our Site. This includes information provided when: (i) registering to use the Site and our Services; and (ii) You report a problem with our Site;
• Records and copies of your correspondence (including email addresses), if You contact us;
• Your responses to surveys that We may ask You to complete for research and/or customer service purposes;
• Details of transactions that You perform on the Site. You will be required to provide financial information for bidding and/or purchasing Units on the Site;
• Your Unit listings on the Site; and
• Your search queries on the Site.

Additionally, You may provide information to be published or displayed (hereinafter “posted”) on public areas of the Site or transmitted to other Users or third parties (collectively “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. We cannot guarantee that your User Contributions will not be viewed by individuals not registered and/or authorized to use the Site.

Information We Collect Through Automatic Data Collection Technologies

As You navigate through and familiarize yourself with our Site, We may use automatic data collection technologies to collect information about your equipment, browsing actions and patterns, including:

• Details of your visits to our Site, including traffic data, location data, logs, and other communication data and the resources that You access and use on the Site; and
• Information about your computer and internet connection, including your IP address, operating system, and browser type.

The information that We automatically collect may include personal information. • To allow You to participate in interactive features on our Site, such as bidding on Units;
• In any other way We may describe when You provide such information; and
• For any other purpose with your consent.

We may also use your information to contact You about services that may be of interest to You.

Disclosure of Your Information

As noted above, We may disclose personal information that We collect or You provide as described in this Policy:

• To our subsidiaries and affiliates;
• To contractors, service providers, and other third parties that We use to support our business;
• To a buyer or other successor-in-interest in the event of a sale, merger, restructuring, reorganization or other transfer of some or all of CAG’s assets, whether as a going concern or as part of a bankruptcy, liquidation or similar proceeding, where personal information held by CAG about our Users is included in the assets transferred;
• To fulfill the purpose for which You provide it. For example, if You give CAG an email address to use the “email a friend” feature of our Site, We will transmit the contents of that email and your email address to the recipients;
• For any other purpose disclosed by us when You provide the information;
• For payment processing and authorization, fraud protection and credit risk reduction, Site evaluation and data analysis, and distributing marketing and promotional materials;
• To comply with the law, to respond to governmental inquiries or requests, to enforce our policies, and/or to protect our or other parties’ rights, and property;
• If We believe disclosure is necessary or appropriate to protect the rights, property, or safety of CAG, our customers or third parties; and
• With your consent.

Choices About How We Use and Disclose Your Information

 We strive to provide You with choices regarding the personal information that You provide to us. We have created mechanisms to provide You with the following control over your information: 

• Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert You when cookies are being sent. As previously noted, if You disable or refuse cookies, some parts of this Site may become inaccessible or may not function properly.

• Promotional Offers from CAG. If You do not wish to have your email address and/or other contact information used by CAG to promote our own services, You can opt-out by logging into the Site and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request to: support@www.centralauctiongroup.com.

Accessing and Correcting Your Information

• You can review and change your personal information by logging into the Site and visiting your account profile page;
• You may also send us an email at: support@www.centralauctiongroup.com to request access to, correct or delete any personal information that You have provided to us. We may not accommodate a request to change information if We believe the change would violate any law, legal requirement or cause the information to be inaccurate; and
• If You delete your User Contributions from the Site, copies of your User Contributions may: (i) remain viewable in archived pages; or (ii) have been copied or stored by other Site users.

California Privacy Rights

• California’s “Shine the Light” law (Civil Code Section § 1798.83) permits Users that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. If You are a minor or a parent/guardian of a minor and have any personal information listed on the Site, please contact CAG immediately to discuss removal of this content from the Site.
