All titled and non-titled equipment and vehicles are sold by Fairbid International, LLC d/b/a Central Auction Group (“Central Auction Group”) on an AS IS basis, with all faults and without warranties, express or implied, including all warranties of merchantability and fitness for a particular purpose.  Central Auction Group makes no representation or warranty relating to the condition of any such equipment, vehicle and/or vehicle parts in connection with any sale and undertakes no duty to confirm the accuracy or completeness of any information provided in oral, written or image form relating to any sale.  Further, Central Auction Group does not represent or warrant that any vehicle sold: (i) currently meets, or can be modified to meet, federal, state and/or local emission, inspection, and/or safety requirements; and (ii) can be legally registered in any state or country.  Certain local, state and country registration and title laws may impact marketability of the vehicle sold by Central Auction Group.  Central Auction Group does not guarantee that equipment and vehicles are free of any defects and will not accept a claim for deficient quality (including quality, condition, age, mileage, etc.).  All sales are final and nonrefundable. 

IN NO EVENT SHALL CENTRAL AUCTION GROUP BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOSS, DAMAGE OR INJURY TO ANY PARTY OR FOR DELAYS OR LOST PROFITS THAT MAY ARISE IN CONNECTION WITH ANY DEFECT IN THE TITLED OR NON-TITLED EQUIPMENT OR VEHICLES.  To the fullest extent permitted by law, Customer shall release and hold Central Auction Group harmless from and against any and all losses, claims, damages, costs and liabilities arising out of any damage, injury or death caused by or connected with Customer’s use, possession, control, maintenance or operation of such equipment or vehicles.
